Terms of Service

Scope. These Terms of Service apply to your use of the RetireMe website and the RetireMe consumer app when you access them for your own personal, non-business purposes. They do not govern financial adviser firms, licensees, or other businesses using RetireMe on behalf of clients; those relationships are covered by separate commercial agreements with Incendio Trading Limited.

1. Who provides the service

RetireMe is the consumer product name. The service is supplied by Incendio Trading Limited (“we”, “us”, “our”), a New Zealand company (NZBN 9429051566835). Contact details are at the end of these terms.

2. Acceptance of terms

By accessing this website or creating or using an account in the RetireMe app, you agree to these Terms of Service and our Privacy Policy (which describes how we handle personal information). If you do not agree, do not use the service.

3. Eligibility

You must be at least 18 years old to use RetireMe. If you are using the service on behalf of someone else, you confirm you have authority to do so and you remain responsible for their compliance with these terms.

4. Nature of the service (not financial advice)

RetireMe provides financial modelling software that lets you simulate retirement and related planning scenarios. RetireMe and Incendio Trading Limited do not:

  • provide regulated financial advice to you;
  • recommend specific financial products;
  • assess whether any investment or strategy is suitable for you; or
  • act as a financial advice provider for the purposes of the Financial Markets Conduct Act 2013 (New Zealand) or give personalised financial advice within the meaning of that Act.

You are solely responsible for interpreting and applying any information the software produces, and for obtaining professional advice where you need it.

5. Illustrative outputs; no sole reliance

All projections, charts, numbers, and scenarios produced by RetireMe are illustrative and hypothetical. They depend on your inputs, assumptions built into the software, and limitations described in our help materials. Results are not promises or forecasts of future performance.

You agree not to rely solely on RetireMe outputs when making significant financial decisions. To the maximum extent permitted by law, we are not liable for loss arising from reliance on those outputs.

6. Artificial intelligence features

The platform may generate commentary, summaries, or suggestions using artificial intelligence (“AI”). Such content:

  • is generated algorithmically and may be wrong, incomplete, or out of date;
  • does not constitute financial, legal, or tax advice;
  • must not be treated as a substitute for a qualified professional; and
  • should be verified by you before you act on it.

7. Privacy and your data

Our Privacy Policy explains what personal information we collect, how we use it, and your rights under the Privacy Act 2020 (New Zealand). By using RetireMe, you acknowledge that we process personal information as described there.

You are responsible for the accuracy of information you enter. You should keep your own copies of important records where the output matters to you.

8. Your account and acceptable use

You are responsible for all activity under your account and for keeping your sign-in credentials secure (including any sign-in you use through a third party, such as Google). Notify us promptly at the contact below if you suspect unauthorised access.

You agree not to use RetireMe or this website to break the law, harass others, attempt unauthorised access to our systems or data, overload or disrupt the service, scrape or data-mine except as allowed by written permission or applicable law, or misrepresent your identity. We may suspend or restrict access where reasonably necessary for safety, legal compliance, fraud prevention, or protection of the service.

9. Fees, subscriptions, and taxes

Some features may be free; others may require a paid subscription or one-off fee as shown at signup or on our pricing page. Unless we say otherwise, fees are in New Zealand dollars and GST (if any) is additional as required by law.

Recurring subscriptions renew according to the plan you select until you cancel using the in-product or account tools we provide, or as described at purchase. If we change pricing, we will tell you in advance where we are required to do so.

Unless mandatory consumer law says otherwise, fees you have already paid are non-refundable except where we explicitly offer a cooling-off or refund in writing.

10. Changes, availability, and discontinuance

We may add, change, or remove features, update methodology, or perform maintenance. We do not guarantee uninterrupted availability.

We may change these Terms of Service from time to time by posting an updated version on this page and updating the “Last updated” date. For material changes, we will take reasonable steps to notify you (for example by email or in-app notice) where practicable. Where required by law, we will obtain your consent or give you a right to terminate. If you continue to use RetireMe after the effective date of an update, you agree to the revised terms.

11. Intellectual property

The RetireMe software, website, branding, designs, text, and related materials are owned by or licensed to Incendio Trading Limited and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use RetireMe for your personal consumer use in line with these terms. You must not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract source code except where the law does not allow us to restrict that.

12. Third-party services

RetireMe may rely on third-party services (for example authentication, hosting, analytics, payment processing, or support chat). Those services are provided by independent suppliers under their own terms and privacy notices. We are not responsible for their availability, conduct, or content.

13. Disclaimers

To the maximum extent permitted by law, RetireMe is provided “as is” and “as available”. Except as expressly required by law, we do not warrant that the service will be uninterrupted, error-free, secure, accurate, complete, or free of harmful components, or fit for a particular purpose beyond what consumer law may imply.

14. Limitation of liability and consumer law

To the maximum extent permitted by New Zealand law:

  • Incendio Trading Limited is not liable for any indirect, consequential, special, exemplary, or punitive loss, or for loss of revenue, profit, data, goodwill, business opportunity, or anticipated savings, arising from or connected with your use of RetireMe or this website; and
  • our total aggregate liability for any and all claims arising out of or relating to RetireMe or this website in any twelve-month period is limited to the greater of (a) the total amount you paid us for RetireMe in the twelve months before the event giving rise to the claim, and (b) NZD 100 (if you did not pay us during that period or paid less than NZD 100).

Consumer Guarantees Act 1993. Where you acquire services as a “consumer” within the meaning of the Consumer Guarantees Act 1993, you may have statutory rights and remedies that cannot lawfully be excluded or limited. Nothing in these terms is intended to exclude or restrict those non-excludable rights. Our limitations apply only to the fullest extent permitted by that Act and other applicable law.

Fair Trading Act 1986. You also have rights under the Fair Trading Act 1986. We will not contract out of the provisions of that Act where the law says we cannot.

15. Ending your use

You may stop using RetireMe at any time by closing your account where that option is available, or by contacting us.

We may suspend or terminate your access if you materially breach these terms, if we must do so to comply with law, or if we discontinue the consumer service (in which case we will try to give reasonable notice where practicable).

Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) continue after termination.

If you have concerns about RetireMe or these terms, contact us first so we can try to resolve them:

Depending on the nature of your complaint, you may also use external dispute or ombudsman schemes or seek advice from Consumer Protection (NZ) or other agencies. We do not promise any particular third-party outcome.

17. General

If any part of these terms is invalid or unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver.

You may not assign these terms without our consent. We may assign our rights and obligations as part of a corporate restructure or sale.

18. Governing law and jurisdiction

These terms are governed by the laws of New Zealand. Subject to any mandatory venue rules that apply to you as a consumer, you and we submit to the non-exclusive jurisdiction of the courts of New Zealand.
